FOLEY v. UNIV. OF HOUSTON SYS., 01-41485

An employee's claim that he was subjected to retaliation because he complained of race discrimination is a cognizable claim under 42 U.S.C. section 1981(b), and the district court properly denied summary judgment as to one such claim. Summary judgment should have been entered on the section 1983 First Amendment retaliation claims.
