United States Fifth Circuit

FLORES-GARZA v. INS, 99-60625, 00-41122

Due to lack of jurisdiction to review a BIA order finding an alien removable based on a controlled substance offense, plaintiff's petition for review is dismissed. However, district court does have jurisdiction to review his petition for federal habeas corpus relief under 28 U.S.C. section 2241.
