United States Fifth Circuit

SALDANO v. O'CONNELL,, 02-41208

The district court erred in holding that the District Attorney's application for intervention presented it with non-justiciable political questions, since the issues raised by the D.A.'s application for intervention were not ones that were constitutionally committed to coordinate branches or political departments, and the case is remanded for consideration of the merits.
