In an appeal of the USDA's reduction of plaintiff's award under the Crop Loss Disaster Assistance Program, summary judgment in favor of the USDA is affirmed where plaintiffs conceded the authority of the USDA to establish a normal crop mortality rate and a maximum loss rate.
