FLOCK v. SCRIPTO-TOKAI CORP., 02-20098

The fact that a lighter manufactured by plaintiff was the only incendiary device that was found in a child's room where a fire started, does create a genuine issue of material fact that on whether the child started the fire using the lighter. Thus, issues of fact preclude an award of summary judgment on this basis.
