A 42 U.S.C. section 1983 claim for malicious prosecution exists under the Fourth Amendment, and evidence was sufficient for a reasonable jury to find that 1) defendants acted without probable cause, and 2) a conspiracy existed to deprive claimant of his Fourth Amendment rights.
