JIMMY SWAGGART MINISTRIES v. HAYES, 01-30454

In this adversary proceeding brought by the trustee of the debtor's bankruptcy estate to recover funds as actual and/or constructive fraudulent conveyances to the defendant, the district court erred in reversing the Bankruptcy Court's finding that the defendant met the requirements of the "good faith" defense under 11 U.S.C. section 548(c); the Bankruptcy Court's order and judgment are reinstated.
