WESTMORELAND v. SADOUX, 01-20793
Where a suit does not seek to enforce any duty arising out of a shareholder agreement, and seeks no relief that would frustrate any right to arbitration under it, a nonsignatory to an arbitration clause cannot compel arbitration based merely on an agency argument. (Revised opinion)
