The question of the constitutionality of 18 U.S.C. section 666, for conspiracy and program bribery violations, is properly before the court on appeal, and the district court had subject-matter jurisdiction over defendant's bribery case; a new trial is necessary where the court transferred the trial sua sponte over defendant's objections.
