United States Fifth Circuit

ANTHONY v. CHEVRON USA, INC., 00-50710

Although plaintiffs' expert's testimony raised suspicions about the defendant's operations in the area of plaintiffs' property, because the expert proposed 3 theories of how the plaintiffs' property was contaminated, and did not provide any evidence establishing a nexus between the defendant's water injection operations and pollution in the area, suspicions were not enough to present a question of fact to the jury on the issue of causation.
