MILLER v. DIAMOND SHAMROCK CO., 00-41341

Where the government approved precise specifications for Agent Orange to be produced by the defendant contractor, the Agent Orange conformed to those specifications, and since the government knew as much as, if not more than, the contractor about the dangers of Agent Orange, summary judgment for contractor based on the military contractor defense theory was proper.
