United States Fifth Circuit

RESERVE MOORING INC. v. AM. COMMERCIAL BARGE LINE, LLC, 00-30611, 00-30944

Physical injury to a proprietary interest is a prerequisite to recovery of economic damages in cases of unintentional maritime tort, so the sinking of a barge physically preventing any other vessel from using a mooring site while the barge is being salvaged does not entitle the owner of the mooring facility to recover its lost income.
