AT&T UNIVERSAL CARD SERV. v. MERCER, 98-60693

Under 11 USC 523(a)(2)(A), obtaining credit by false pretenses/representation, actual fraud, a debtor's "hopeless insolvency," or inability to pay at time of usage may support a finding that debtor did not intend to pay, but only if she knew she could not and therefore did not intend to make even the minimum monthly payment.
