US v. MAREK, 98-40568 & 98-40955
The phrase "facility in interstate commerce" in the federal murder-for-hire statute, 18 USC 1958, is synonymous with the use of an "interstate commerce facility" and satisfies the jurisdictional element of the statute, irrespective of whether the particular transaction in question is itself interstate or wholly intrastate.
