US v. Garnett Hodge, 17-6054
Reversed and remanded. Defendant received a mandatory sentence enhancement under the Armed Career Criminal Act based on three prior convictions. One of those convictions no longer qualifies as an ACCA predicate. The Fourth Circuit held that defendant’s sentence is unlawful in spite of the government’s argument that they could substitute another crime.
