US v. McCoy, 17-4117
Affirmed a conviction and sentence for federal drug trafficking conspiracy where a defendant pleaded guilty and waived his right to appeal except on the basis of ineffective assistance of counsel or prosecutorial misconduct. Defendant's appeal argued that a factual basis did not support his guilty plea, which he could argue as this type of challenge falls outside the scope of a valid waiver. However, in affirming the Fourth Circuit held that a factual basis did, in fact, support his plea.
