Burkhart v. Grigsby, 161971
Reversing a bankruptcy court's refusal to strip valueless liens from a Chapter 13 debtor's principal residence where no proof of claims had been filed because there was no question that the liens were entirely without value making the creditor the holder of an unsecured claim, so the liens could be stripped regardless of whether proof of a claim had been filed.
