United States Fourth Circuit
Kenny v. Wilson, 171367
Vacating and remanding the district court dismissal of a suit brought by South Carolina students complaining that the Disturbing Schools Law and Disorderly Conduct Law are unconstitutionally vague because, while some students merely complained of possible future arrest, others had previously been arrested and charged and the laws, in any event, could chill their exercise of free expression sufficient to support the action.
