Affirming the district court's denial of summary judgment on a motion for federal qualified immunity and related state defenses in the case of two officers' fatal shooting of a man who held a handgun when they responded to a domestic abuse call but did not raise his gun and the officers made no announcement or warning prior to shooting because their probable cause was question of fact for the jury.
