In a constitutional takings case involving a city of Rockville zoning ordinance prohibiting construction of self-storage facilities within 250 feet of a public school, the district court's dismissal is affirmed where 1) plaintiff's failure to apply for a building permit defeats its claim of a protected property interest; and 2) the ordinance was neither an arbitrary action targeting plaintiff nor an equal protection violation violating the Fourteenth Amendment.
