Janya Sawyer v. Foster Wheeler LLC, 161530

In a mesothelioma that case that asked whether a government contractor could remove a state tort action to federal tort based on the contractor's assertion that it had a colorable federal defense of government-contractor immunity, the court reversed the district court's conclusion that the conclusion that the contractor did not meet the substantive requirements to remove the case, but also remanded to determine whether the request was timely.
