Leichling v. Honeywell International, Inc., 15-2263

In an action brought by survivor's of deceased plaintiff, alleging that plaintiff's fatal lung cancer resulted from exposure to toxins during his employment at the Dundalk Marine Terminal in Baltimore, Maryland, where defendant operates a chemical manufacturing plant, the district court's dismissal of the suit is affirmed where the action is barred by Maryland’s 20-year statute of repose, which bars untimely claims for injuries resulting from a 'defective and unsafe condition of an improvement to real property,' Md. Code Ann., Cts. & Jud. Proc. section 5-108(a).
