Dilworth v. Adams, 15-6910
In a 42 U.S.C. section 1983 action brought against prison officials by a pretrial detainee at North Carolina's New Hanover County Detention Facility who spent a total of 85 days in disciplinary segregation as punishment for two disciplinary infractions, arguing that the imposition of disciplinary segregation without a hearing violated his procedural due process rights, the District Court's grant of summary judgment to defendants is reversed where, as a pretrial detainee, plaintiff was entitled to a hearing before he was punished.
