United States Fourth Circuit

Ripley v. Foster Wheeler LLC, 15-1918

In a product liability case alleging failure to warn of asbestos hazards in products manufactured for the Navy, the District Court's remand to state court, after defendant removed the case to federal court pursuant to the federal officer removal statute, is reversed where, given the weight of opposing precedent and the rationales supporting the defense, the government contractor defense is available in failure to warn cases.
