United States Fourth Circuit

US v. Garcia-Lagunas, 14-4370

Conviction for conspiracy to distribute or possess cocaine is affirmed where a detective's testimony that 'Hispanic drug traffickers' 'send the majority if not all of the proceeds back to their native countries' was unconstitutional, but harmless, error. The court vacated defendant's sentence because the district court plainly erred in calculating defendant's Guidelines range.
