US v. Batato, 15-1360

In a civil forfeiture action against funds deposited in the claimants' names in banks in New Zealand and Hong Kong, the District Court's entry of default judgment for the government is affirmed over claimants' arguments that: 1) the district court lacked jurisdiction over the defendant property because it resides in foreign countries; 2) the fugitive disentitlement statute, 28 U.S.C. section 2466, violates constitutional due process; and 3) disentitlement in this case was improper because the claimants are not fugitives from the law.
