Convictions by conditional guilty plea to possessing a firearm as a felon, possessing heroin with intent to distribute, and possessing marijuana with intent to distribute, 18 U.S.C. section 922(g)(1) and 21 U.S.C. section 841(a), are vacated where, if defendant did not preserve his right to appeal the denial of the motion by the terms of his guilty plea, then his guilty plea should vacated.
