G.G. v. Gloucester County Sch. Bd., 15-2056

In a suit brought by a transgender boy who seeks to use the boys' restrooms at his high school, alleging that the school board impermissibly discriminated against him in violation of Title IX and the Equal Protection Clause of the Constitution, the district court's dismissal of the Title IX claim and denial of plaintiff's request for a preliminary injunction is: 1) reversed as to the Title IX claim where the district court did not accord appropriate deference to the relevant Department of Education regulations; 2) vacated as to the the denial of motion for preliminary injunction where the district court used the wrong evidentiary standard in assessing the motion; and 3) remanded for consideration under the correct standard.
