Dell Webb Communities, Inc. v. Carlson, 15-1385
In a dispute resolution and arbitration action, the district court's order denying plaintiff's motion for partial summary judgment is reversed. The court held that whether an arbitration clause permits class arbitration is a gateway question of arbitrability for the court instead of a procedural question for the arbitrator.
