United States Fourth Circuit
Groves v. Communication Workers of America, 14-1854
In a labor and employment action, arising after plaintiffs were terminated from AT&T Mobility and filed against their former employer and defendant union, the district court’s grant of defendant’s motion for summary judgment is affirmed because any breach of the union's duty of fair representation did not contribute to plaintiffs' failure to exhaust their contractual remedies as required by section 301 of the Labor Management Relations Act, 29 U.S.C. section 185.
