K& D Holdings v. Equitrans, 15-1166
In a case involving a lease for the production, exploration, and storage of oil and gas, the district court's judgment that the lease was divisible into two segments and that the production and exploration segment had expired is reversed where: 1) the district court erred in its sua sponte decision that the lease was divisible; and 2 ) a portion of the leased land is being used for the storage of gas and triggers the lease's durational provision.
