Convictions arising from a foiled murder-for-hire plot are affirmed where: 1) the district court's jury instructions did not constructively amend the indictment in violation of defendants Fifth Amendment rights; and 2) the admission of a conspirator's out-of-court statements and character evidence relating to defendant Moore were not in error.
