Estate of Armstrong v. Village of Pinehurst, 15-1191
In a 42 U.S.C. section 1983 action arising from the death of Ronald H. Armstrong after being tased by police, the district court's grant of summary judgment to defendants is affirmed where: 1) defendant police officers used unconstitutionally excessive force by tasing a stationary, non-violent, but resisting Armstrong during the execution of an involuntary commitment order; but 2) defendants are entitled to qualified immunity because Armstrong's right not to be tased under the circumstances was not clearly established at the time.
