US v. Martinovich, 13-4828

Conviction for mail fraud and wire fraud in connection with a scheme to defraud clients at defendant's investment firm is affirmed but the sentence is vacated and remanded where: 1) the district court's interference in defendant's trial constituted error but did not deprive defendant of a fair trial; and 2) the district court erred in treating the sentencing guidelines as mandatory and such error was not harmless.
