US v. Barlow, 15-4114

Sentence for possession of a firearm as a felon is vacated and remanded for resentencing where defendant's two prior convictions for speeding to elude arrest no longer qualify as violent felonies under the Armed Career Criminal Act, making his fifteen-year sentencing enhancement invalid. The court further held that North Carolina law includes post-release supervision as part of a felon's term of imprisonment for the purposes of 18 U.S.C. section 922(g)(1).
