Gray v. Zook, 12-5

In a habeas corpus case, the district court's dismissal of the petition is affirmed where: 1) The Supreme Court of Virginia's resolution of defendant's ineffective-assistance-of-counsel claim without an evidentiary hearing was not an unreasonable determination of the facts under 28 U.S.C. section 2254(d)(2); and 2) petitioner's ineffective assistance of trial counsel claim was raised in state proceedings and not subject to de novo review under Martinez v. Ryan, 132 S. Ct. 1309 (2012).
