US v. Pa. Higher Educ. Assistance Agency, 15-1093

In an action brought under the False Claims Act, 31 U.S.C. sections 3729-33, claiming that defendant Pennsylvania Higher Education Assistance Agency fraudulently claimed hundreds of millions of dollars in federal student-loan interest-subsidy payments to which it was not entitled, the district court's grant of summary judgment to defendant is vacated and remanded where defendant is an independent political subdivision subject to liability under the False Claims Act.
