Porter v. Zook, 10/26/2015 CA Appeals
In a habeas corpus petition following petitioner's conviction for capital murder, the court concluded that it lacked appellate jurisdiction and dismissed the appeal for want of jurisdiction where the district court failed to consider petitioner's claim of actual juror bias in violation of his right to trial by an impartial jury under Smith v. Phillips, 455 U.S. 209 (1982).
