Watkins v. Rubenstein, 14-6513
In a 28 U.S.C. section 2254 habeas corpus petition alleging that a West Virginia prosecutor withheld information from the defense regarding the victim of an attempted robbery's lack of fear of bodily injury, in violation of Brady v. Maryland, 373 U.S. 83 (1963), the district court's order granting habeas corpus relief is reversed where: 1) insufficient deference was paid to the factual findings of the state habeas court; and 2) the state court's rejection of petitioner's Brady claim was not unreasonable.
