In a civil action brought by a receiver for a bank against several officers and directors of a failed North Carolina bank, alleging negligence, grossly negligence, and breach of fiduciary duty resulting in the failure of the bank, the district court's grant of summary judgment to defendants is: 1) vacated as to summary judgment on plaintiff's claims of ordinary negligence and breach of fiduciary duty; and 2) reversed as to the order denying as moot plaintiff's cross-motion for summary-judgment, as well as its order denying as moot plaintiff's motion to exclude a declaration and attached exhibits.
