Elderberry of Weber City, LLC v. Living Centers, 13-2176
In a consolidated action alleging breach of a lease for a skilled nursing facility and breach of guaranty contract, the district court's decision denying of the parties' cross motions for summary judgment, conclusion that the guaranty was enforceable against defendant, and award of damages is reversed in part as to the calculation of damages where the court erred in awarding damages that accrued after the termination of the lease.
