US v. Tuomey, 13-2219

In a qui tam action in which the government intervened, the district court's judgment vacating a jury's verdict that defendant did not violate the False Claims Act (FCA), 31 U.S.C. sections 3729-33 (2012), and granting a new trial in which the government prevailed is affirmed where the district court correctly granted the government’s motion for a new trial where the government was was prejudiced by the exclusion of certain testimony and other related evidence of warnings to defendant regarding the legal peril that the employment contracts posed.
