Pender v. Bank of America Corp., 14-1011
In an ERISA case in which an IRS audit revealed that an employer wrongly transferred assets from a pension plan that enjoyed a separate account feature to a pension plan that lacked one, the district court's dismissal for lack of statutory and Article III standing is reversed where plaintiffs have both statutory and Article III standing and plaintiff's claim is not time barred.
