Plaintiff-school brought suit against defendant private accrediting agency for violation of its due process rights after defendant denied plaintiff's application for re-accreditation in 2010. The district court awarded plaintiff damages and reinstated its accreditation. The judgment of the district court is reversed as to the accreditation decision, affirmed as to the dismissal of plaintiff's various state law claims, and remanded with directions to enter judgment in favor of defendant as to the due process claim, where: 1) the district court erred when it took what amounted to a de novo approach to the accreditation process that resulted in a wholesale substitution of the judgment of the court for that of the accrediting agency; and 2) judged by the correct standard of review, the accreditation decision made by defendant was well supported and not arbitrary or capricious.
