Nezirovic v. Holt, 14-6468

In this case, petitioner is a citizen of Bosnia and Herzegovina who entered the United States as a refugee in 1997 in the wake of the war in former Yugoslavia. In 2012, Bosnia and Herzegovina requested petitioner's extradition based on alleged war crimes he committed during the conflict. Denial of petition for habeas relief challenging the magistrate judge's issuance of a certification of extraditability, finding that petitioner was subject to extradition under a treaty between the United States and Bosnia and Herzegovina, is affirmed, where: 1) petitioner's extradition is not time-barred; and 2) the acts of torture allegedly perpetrated by petitioner against civilians preclude application of the political offense exception in the treaty.
