Reynolds v. Middleton, 13-2389
In this case, plaintiff, a homeless man, challenges a Henrico County ordinance that prohibits solicitation within County roadways on grounds that the ordinance violates the First Amendment. Summary judgment in favor of the County is vacated and the case is remanded, where: 1) the County's evidence failed to establish that the Amended Ordinance was narrowly tailored; but 2) the County should have an opportunity to gather an present evidence sufficient to satisfy the McCullen v. Coakley standard.
