Harrison v. Wells Fargo Bank, 13-2379

In this case, plaintiff brought suit against defendant-employer, arguing that defendant improperly terminated her short-term disability benefits while she was undergoing a series of treatments for thyroid disease. Judgment upholding the decision to terminate the short-term disability benefits is reversed and remanded, where, because defendant failed to consider readily available material evidence that confirmed plaintiff's theory of disability, and of which it was put on notice, the review process failed to conform to the directives of ERISA and the Plan's own terms.
