US v. Avila, 13-4606

After pleading guilty to illegal reentry in violation of 8 U.S.C. section 1326(a), defendant was sentenced to a thirty-seven month sentence. The sentence is affirmed, where: 1) first-degree burglary is a crime of violence within the meaning of 18 U.S.C. section 16(b) and qualifies as an aggravated felony, and the district court therefore correctly applied the eight-level enhancement under U.S.S.G. section 2L1.2(b)(1)(C); and 2) the district court's sentencing colloquy was procedurally adequate.
