Minter v. Wells Fargo Bank, N.A., 13-2131

In a class action alleging that defendants violated Section 8 of the Real Estate Settlement Procedures Act (RESPA), by creating a joint venture, to skirt RESPA's prohibition on kickbacks while failing to disclose this business arrangement to its customers, judgment in favor of defendant that foreclosed plaintiffs' untried kickback claims is affirmed, where: 1) plaintiffs failed to move for judgment as a matter of law before the jury reached its verdict; and 2) the district court did not abuse its discretion as to any of plaintiffs' challenges.
