Marshall v. James B. Nutter & Company, 13-1940

Summary judgment for defendant in an action alleging that defendant was liable as a civil coconspirator under the Maryland Finder's Fee Act for fees that a bank lender charged plaintiff at closing for a loan that defendant funded pursuant to a preexisting agreement, is affirmed, where the district court correctly concluded that: 1) defendant could not be a violator of the Act because that statute regulates only mortgage brokers and defendant was not a "mortgage broker" in the transaction; and 2) because defendant was not "legally capable" of violating the Act, it could not be held liable for conspiring with the bank lender to violate the Act.
